1. Who we are

Twitchspy ("Twitchspy", "we", "us", "our") is a trading name of Axiometra Limited, a company registered in Scotland (company number: SC892597). Our registered office is at 3 Prospect Place, Westhill, Aberdeenshire, AB32 6SY. You can contact our team at contact@twitchspy.app.

2. Acceptance of Terms

By creating an account, connecting a streaming profile, or interacting with Twitchspy (the "Service"), you enter into a legally binding contract with us and agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use the Service.

3. The Service and Third-Party Dependencies

Twitchspy provides analytical dashboards, category growth rankings, and predictive streaming schedule recommendations.

  • Data Sources: Our metrics are derived using public APIs, including the Twitch API and other third-party networks. We do not guarantee the real-time accuracy, completeness, or uninterrupted availability of this data.
  • Platform Terms: Your use of our Service is strictly contingent on your compliance with the Twitch Developer Services Agreement and Twitch's Terms of Service. If your Twitch account is suspended, terminated, or restricted by Twitch, your ability to access Twitchspy may be impacted, and we bear no liability for such platform-enforced disruptions.

4. Eligibility and Accounts

  • Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service.
  • Authentication: Account registration and login are processed securely via Twitch OAuth. You are entirely responsible for all activities, data syncing, and API queries that occur under your account credentials.

5. Subscriptions, Local Taxes, and Currency Exchange

  • Free Plan: Available at no cost, with restricted dashboard access and limited category history.
  • Pro Plan: See [Prices] page for current prices. These prices are denominated strictly in British Pounds Sterling (GBP).
  • International Billing: If you purchase a subscription from outside the United Kingdom, the final amount charged to your card may vary depending on local tax requirements (such as state sales tax or international VAT) and the prevailing currency conversion rates applied by your bank or our payment processor (Stripe).
  • Billing Cycles: Subscriptions are billed upfront via Stripe and renew automatically at the end of each monthly or annual cycle unless cancelled. You may cancel via your online Account settings page at any time. Upon cancellation, your Pro features will remain active until the end of your current paid billing period, after which your account will automatically downgrade to the Free Plan.
  • Price Modifications: We reserve the right to adjust subscription rates upon 14 days' notice sent via email or an in-app notification. Price updates will apply only to subsequent renewal periods.

6. Acceptable Use and Anti-Scraping Protections

You are granted access to Twitchspy solely for your own personal or internal business stream optimization. You explicitly agree that you will not:

  • Scrape or Extract: Automatically harvest, scrape, crawl, mirror, extract, or download data, metrics, or rankings from the Service using bots, scripts, extensions, or automated tools.
  • Reverse-Engineer: Disassemble, decompile, or reverse-engineer the web application code, frontend framework, or underlying algorithms.
  • Compete: Use the aggregated insights, viewer-to-streamer ratios, or hourly analytics to build a competing data-analytics product or service.
  • Abuse Infrastructure: Exceed reasonable interactive use limits, circumvent rate-limiting mechanisms, or disrupt the performance of our servers.

7. Intellectual Property Rights

We (and our licensors) retain exclusive ownership of all global intellectual property rights in Twitchspy, including the software code, brand name, user interface designs, logos, and proprietary data aggregation methodologies. We grant you a limited, non-exclusive, non-transferable, revocable licence to view the data for its intended purpose while your account is active. We claim no ownership over your independent Twitch channel assets, stream content, or personal branding.

8. Disclaimers and No Guarantees of Success

The Service is provided strictly on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all implied warranties, including satisfactory quality or fitness for a particular purpose. Twitchspy provides analytical estimations; we do not warrant or guarantee that following our category rankings or recommended go-live hours will result in increased viewership, channel growth, partnership status, or revenue.

9. Limitation of Liability

  • Statutory Minimums: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully restricted under Scots law.
  • Financial Cap: Subject to the above, our cumulative liability to you for any claim (whether in contract, delict including negligence, statutory duty, or otherwise) arising from or relating to the Service is strictly capped at the total amount you paid to us for your subscription during the twelve (12) months immediately preceding the event that triggered the claim.
  • Exclusion of Losses: Under no circumstances shall Axiometra Limited be liable for any loss of profits, loss of streaming revenue, loss of business opportunities, damage to reputation/goodwill, or any indirect, incidental, or consequential financial losses.

10. Termination and Account Suspension

You may stop using the Service and request the deletion of your account profile at any time. We reserve the right to suspend or permanently terminate your access to Twitchspy immediately, without prior notice, if you breach these Terms, if we detect fraudulent payment activity, or if your usage poses an immediate security or legal threat to our platform.

11. Amendments to These Terms

We may update these Terms from time to time to reflect changes in platform features, API rules, or regulatory laws. For material changes, we will provide you with at least 14 days' prior notice via email or a prominent notification within the app dashboard. Your continued use of Twitchspy following the conclusion of the notice period constitutes total acceptance of the revised Terms.

12. Governing Law and Legal Jurisdiction

  • The Core Rule: These Terms, and any contractual or non-contractual disputes arising from them, are governed exclusively by and construed in accordance with the laws of Scotland.
  • The Courts: Both parties irrevocably agree that the Scottish courts have exclusive jurisdiction to settle any legal claim or dispute.
  • Consumer Carve-Out: If you are an individual consumer residing in England, Wales, Northern Ireland, the European Union, or any other global territory, this section does not strip away any mandatory, non-waivable local consumer protections or venue rights guaranteed to you by your home country's laws.
